Understanding the T Visa
There are four key eligibility requirements for a T visa: being a victim of severe trafficking; being physically present in the U.S. due to trafficking; cooperating with law enforcement (with exceptions for minors and trauma cases); and providing evidence of extreme hardship upon removal.

There is a distinction between sex trafficking, defined as a commercial sex act induced by force, fraud, or coercion, and labor trafficking, which involves involuntary servitude across multiple industries.
Application Process
Applicants file Form I-914 with supporting evidence including personal statements, medical records, police reports, witness affidavits, and hardship documentation.
Family Inclusion and Permanent Residency
Applicants under 21 may include spouses, children, parents, and unmarried siblings under 18 in their application. After three years, applicants may pursue permanent residence leading toward citizenship.
